General Terms and Conditions (GTC)
1. Scope and Provider
These General Terms and Conditions apply to all orders placed via the online shop Soundtrade.ch.

Sacom AG is the contractual party for all orders placed via Soundtrade.ch.
By submitting an order, the customer confirms having read and accepted these GTC.
2. Offer and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By placing an order, the customer makes a binding offer to conclude a sales contract.
A contract is only concluded once the order has been expressly confirmed or the goods have been shipped.
We reserve the right to refuse orders on a case-by-case basis without providing reasons.
3. Prices and Availability
All prices are stated in Swiss francs (CHF) including statutory VAT, unless otherwise specified.
The price applicable is the one valid at the time of the order.
Despite careful maintenance of product data, pricing, description, or assortment errors may occur. In such cases, we reserve the right not to fulfil or to adjust the order.
All availability information is non-binding and may be changed at any time.
4. Payment Terms
The available payment methods are displayed during the checkout process.
We reserve the right to exclude certain payment methods without providing reasons.
For advance payment, shipment will only take place after full receipt of payment.
For purchase on invoice, the customer undertakes to pay the invoice amount within the specified period.
In case of late payment, statutory default interest and reasonable reminder fees may be charged.
5. Delivery and Shipping
Delivery is generally made within Switzerland and Liechtenstein to the address provided by the customer.
Delivery times are non-binding unless expressly agreed otherwise.
Partial deliveries are permitted insofar as they are reasonable for the customer.
Where legally permitted, benefit and risk transfer to the customer upon handover of the goods to the carrier.
6. Inspection Obligation and Notice of Defects
The customer is obliged to inspect the goods immediately upon receipt.
Obvious defects or transport damages must be reported within 5 calendar days of receipt.
If the customer fails to notify within the required period, any related claims may be forfeited to the extent permitted by law.
7. Returns and Right of Return
There is no statutory right of withdrawal under Swiss law.
Regardless of this, we may grant a voluntary right of return. The conditions communicated at the time of purchase shall apply.
Returns are made at the customer’s expense and risk unless otherwise agreed.
Excluded from return rights are in particular:
opened or used hygiene products
products specially ordered or manufactured for the customer
used, damaged or incomplete products
8. Warranty
The statutory warranty provisions of the Swiss Code of Obligations apply.
Warranty claims may be fulfilled, at our discretion, by replacement or repair, where legally permissible.
Any further claims are excluded to the extent permitted by law. Mandatory statutory rights of the customer remain reserved.
Manufacturer warranties remain unaffected.
9. Liability
We are fully liable for damages caused intentionally or by gross negligence.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal duties), limited to the typical foreseeable damage.
Liability for indirect damages, consequential damages or loss of profit is excluded to the extent permitted by law.
10. Retention of Title
The delivered goods remain the property of Sacom AG until full payment has been received.
11. Data Protection
Personal data is processed in accordance with the Swiss Data Protection Act (revDSG).

12. Copyright
All content on Soundtrade.ch, in particular texts, images and logos, is protected by copyright.
Any use without prior written consent is prohibited.
13. Amendments to the GTC
We reserve the right to amend these GTC at any time.
The version applicable is the one in force at the time of the order.
14. Applicable Law and Jurisdiction
Swiss law applies exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction is the registered office of Sacom AG, unless mandatory legal provisions state otherwise.
15. Final Provisions
If any provision of these GTC is found to be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
