General Terms and Conditions (GTC) – Soundtrade.ch
1. Scope and Provider
These General Terms and Conditions apply to all orders placed through the online shop Soundtrade.ch.

Sacom AG is the contractual partner for all orders placed through Soundtrade.ch.
By submitting an order, the customer confirms that they have read and accepted these GTC.
2. Offers and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding invitation to place an order.
By placing an order, the customer submits a binding offer to conclude a purchase agreement.
The contract is only concluded once Soundtrade.ch explicitly confirms the order or dispatches the goods.
Soundtrade.ch reserves the right to refuse orders without stating reasons.
3. Prices and Availability
All prices are stated in Swiss Francs (CHF) including statutory VAT unless otherwise indicated.
The applicable price is the one valid at the time of the order.
Despite careful maintenance, pricing or assortment errors may occur. In such cases, Soundtrade.ch reserves the right not to fulfill orders.
All availability information is without guarantee and may change at any time.
4. Payment Terms
The available payment methods are displayed during the ordering process.
Soundtrade.ch may exclude certain payment methods without giving reasons.
For advance payments, goods are shipped only after receipt of payment.
When purchasing on invoice, the customer undertakes to pay the invoice amount within the specified period.
In the event of late payment, default interest and reminder fees may be charged.
5. Delivery and Shipping
Delivery is generally made within Switzerland and Liechtenstein to the address provided by the customer.
Delivery times are non-binding unless expressly agreed otherwise.
Partial deliveries are permitted insofar as they are reasonable for the customer.
Benefits and risks transfer to the customer upon handover to the transport service provider, insofar as legally permitted.
6. Inspection Obligation and Notification of Defects
The customer is obliged to inspect the goods immediately upon receipt.
Obvious damage or defects must be reported within 5 calendar days.
If the customer fails to report defects in due time, the goods shall be deemed approved insofar as legally permitted.
7. Returns and Right of Withdrawal
There is no statutory right of withdrawal in Switzerland.
Soundtrade.ch may voluntarily grant return rights. The return conditions communicated at the time of purchase shall apply.
Returns are made at the customer’s expense and risk unless otherwise agreed.
The following items are excluded from returns in particular:
- opened hygiene products
- special-order products
- used or damaged products
8. Warranty
The statutory warranty provisions of Swiss Code of Obligations apply.
Soundtrade.ch may fulfill warranty claims at its discretion through replacement delivery or repair.
Further claims, particularly cancellation of sale or price reduction, are excluded to the extent permitted by law.
Manufacturer warranties remain unaffected.
9. Liability
Soundtrade.ch shall only be liable for damages caused by intentional or grossly negligent conduct.
Liability for indirect damages, consequential damages, or loss of profit is excluded to the extent permitted by law.
10. Retention of Title
The delivered goods remain the property of Sacom AG until full payment has been made.
11. Data Protection
The processing of personal data is carried out in accordance with the applicable Swiss data protection regulations (revDSG).

12. Copyrights
All content on Soundtrade.ch, especially texts, images, and logos, is protected by copyright.
Any use without explicit permission is prohibited.
13. Amendments to the GTC
Soundtrade.ch reserves the right to amend these GTC at any time.
The version valid at the time of the order shall apply.
14. Applicable Law and Jurisdiction
Swiss law shall apply exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction shall be the registered office of Sacom AG, unless mandatory statutory provisions provide otherwise.
15. Final Provisions
Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
